Those who need housing in hostels for students on basic educational programs secondary vocational and higher education on full-time training and for the period of passing the intermediate and final certification for students according to these educational programs for distance learning by organizations that carry out educational activities, living quarters are provided in dormitories if these organizations have the appropriate housing stock.

2. Residential premises in dormitories are provided to students in the manner prescribed by local regulations of organizations engaged in educational activities. For students specified in part 5 of article 36 of this federal law, living quarters in dormitories are provided on a priority basis. With each student living in a residential building in a hostel, a contract for renting a residential building in a hostel is concluded in the manner prescribed by housing legislation. If there are students who need living quarters in dormitories, it is not allowed to use such living quarters for purposes not related to the students living in them.

3. Tenants of residential premises in dormitories included in the housing stock of organizations engaged in educational activities, under contracts for renting residential premises in a dormitory, pay a fee for the use of residential premises (rental fee) and utility services.

4. The amount of payment for the use of residential premises (rental fees) in a dormitory for students is established by organizations engaged in educational activities, depending on the quality, amenities, location and layout of residential premises in the dormitory. The amount of payment for the use of residential premises (rental fees) in a hostel for students is determined by the local normative act adopted taking into account the opinion of student councils and representative bodies of students in organizations engaged in educational activities (if any). The amount of the payment for the use of residential premises (rental fee) in the dormitory for students determined in the said act cannot exceed maximum size such a fee established by the founders of these organizations.

5. The procedure for determining the amount of payment for utilities paid by tenants of residential premises in dormitories included in the housing stock of organizations engaged in educational activities, under contracts for renting residential premises in a dormitory, is established by the Government of the Russian Federation.

6. An organization carrying out educational activities has the right to reduce the amount of payment for the use of residential premises (rent) and (or) the amount of payment for utilities in a hostel for students or not to charge such a fee from certain categories of students, taking into account the opinion of student councils and representative bodies of students in organizations engaged in educational activities (if any). The persons specified in Part 5 of Article 36 of this Federal Law shall be exempted from paying a fee for the use of residential premises (rental fees) in a dormitory.
